Re: Woodwares closing / Sainsburys coming to Portobello

Reading the piece in today's Evening News makes me glad I moved out of Porty. NIMBYism at its very worst. I do despair.

Re: Central Bar - concern over opening hours

Playing devil's advocate here, but surely even with a 9am licence these kids still potentially could be walking past people who have been drinking for four hours come lunchtime, or seven hours come home time? On that basis is the 7am opening really that much of a concern?

Re: New Portobello High School - PPAG Judicial Review

Pal of Porty wrote: I just hope the Council will commence with the building work once PPAG have lost this appeal.
If the appeal is lost it remains to be seen whether an appeal is made to the Supreme Court in London - but the costs of that would make the Court of Session costs look like small change.

Re: New Portobello High School - PPAG Judicial Review

The best way of proceeding with the school as soon as possible is to destroy PPAG financially. Jamesie-In closing or to be precise; when PPAG sat down, our Counsel requested that a decision on expenses should be deferred, not sure of the implications? Difficult to say why without being there to see...

Re: New Portobello High School - PPAG Judicial Review

Marilyne MacLaren spoke at today's demo in the park. Interestingly, not only are the council suing for costs, they will also ask the court to ensure that PPAG put up a bond, in advance of their appeal. Suspected this might occur - known as caution (pronounced kayshon) - the likelihood being no bond...

Re: New Portobello High School - PPAG Judicial Review

Surely in cases such as this when the council have won the first case and an appeal is brought the council would then go after costs (in this case from PPAG) for costs from the first case? That seems fair to me. That would make sense but it actually isn't the case. The marking of an appeal normally...

Not had time to read through the whole thread so apologies if this has already been covered, but did the Petitioners seek a protective costs order at the start of the hearing, and if so were they successful?

You mean the judge making the appeal rather than the parties? That wouldn't be possible in terms of the Court of Session Rules - it's up to one of the parties to kickstart the appeal process.

Re: New Portobello High School - PPAG Judicial Review

Question. If Lady Dorrian finds in favour of the Council, do PPAG have any further recourse to appeal? Is there a higher court or will this finally be an end to it? I believe any decision from the Court of Session can be appealed in the Supreme Court so my guess would be that they could appeal. How...

The majority of those crimes were carried out by the same perpetrators unfortunately. The penalties handed out by the courts for this are of no deterrent whatsoever - the guy who stole mine didn't even get a fine.
